Tamil Nadu government has full powers to decide on release of 7 accused in Rajiv Gandhi murder case - Supreme Court

Former Prime Minister Rajiv Gandhi was murdered on May 21, 1991 at Chennai's election campaign rally in Sriperumbudur.

In this case Murugan, Santhan, Perarivalan, Nalini, Robert Paes, Ravichandran and Jayakumar were sentenced to seven others. Murugan, Shanthan and Perarivalan were sentenced to three persons and sentenced to life imprisonment for 4 others including Nalini.

The three convicted persons sent a mercy petition to the President. The Supreme Court instructed the court to impose a sentence on the mercy petitions and reduce their sentence to life imprisonment in 2014. It also said that the government could take a decision on the release of these three.

Following this, the Tamil Nadu government announced that it will release Nalini, Robert Paes, Ravichandran and Jayakumar, who have already been sentenced to life imprisonment in the case without Murugan, Shanthan and Perarivalan.

The Congress coalition government, which was in the middle of the controversy over the decision of the Tamil Nadu government, filed a 'rit' in the Supreme Court. The Supreme Court, which accepted the petition, ordered the interim ban on release of seven. Subsequently, the Tamil Nadu Government filed a review petition against the order issued by the Constitution which was constituted to investigate the case.

Meanwhile, Murugan, Santhan and Perarivalan demanded that the Tamil Nadu government demand for their release in the jail for more than 20 years. Nalini filed a petition in the Chennai High Court to order the Tamil Nadu government to release her.

Subsequently, the Tamil Nadu government reviewed their demands, wrote in 2 letters in 2016, ending all of them for 24 years in prison because they have decided to release them and demand the approval of the central government. But the central government did not respond.

Meanwhile, the Supreme Court issued a directive on January 23 that the Central Government should notify the Central Government within three months of the release of seven culprits in the trial petition filed by the Tamil Nadu Government.

Following this, the Ministry of Home Affairs will send the details of the sentencing and prosecution of the seven prisoners, including health, mental, economic background, social background, family environment, prisoner Murugan, Santhan, Perarvivalan, Nalini, Robert Paes, Ravichandran and Jayakumar. The letter was sent to the Government of Tamil Nadu.

It is reported that the Tamil Nadu government has sent a proper response to that letter of the central government.

The Government of Tamil Nadu sent the details and documents requested by the Central Government to the Rajiv Gandhi killers. The Central Home Ministry has written a letter on April 18 this year. Rajiv's killers have claimed that seven people should not be released.

In the case of Rajiv Gandhi's murder, seven people, including Perarivalan, Murugan, Shanthan and Nalini, have been convicted over the past 27 years. The Government of Tamil Nadu has written a letter twice to the Union Home Ministry for the past four years to release them on the basis of mercy. But two letters were rejected.

The Tamil Nadu government has demanded that the Center should re-examine the release of seven persons including Rajiv Gandhi's murder case.

The Supreme Court has accepted the additional documents submitted by the Central Government in refusing to release them in the Supreme Court.

In this case, the case was filed before Judge Ranjan Gokai Session. The Tamil Nadu government has the full powers to decide on the release of seven of the culprits who killed Rajiv Gandhi. In this regard, the Tamil Nadu government ordered the Governor of Tamil Nadu to recommend.
